These Terms of Sale (“Terms”) apply to all purchases made from BeBright+Fun Ltd (“we”, “us”, “BeBright+Fun”). By completing a purchase or accessing any of our digital or live services, you agree to these Terms.

These Terms work alongside our Terms of Service, Refund Policy, Privacy Policy, and Safeguarding Policy.

1. About Us


BeBright+Fun Ltd is a company registered in England & Wales.
We provide children’s SATs preparation programmes, learning modules, wellbeing modules and (where applicable) live group lessons or 1:1 mentoring.

Parents purchase access on behalf of their child.


2. Nature of the Services

Our programmes may include:

  • Digital content delivered instantly (videos, worksheets, quizzes, games, comics, animations, wellbeing modules).

  • Scheduled live online sessions (Mini Pods, 1:1 mentoring).

  • Parental resources, guides, and support material.

All programmes that include live lessons are sold as a blended digital package. The digital content forms the primary value and is delivered immediately upon purchase.

3. Ordering & Contract Formation


3.1 A legally binding contract is formed when:

  • you complete checkout,

  • tick the mandatory consent checkbox, and

  • receive confirmation of enrolment.

3.2 You must be over 18 and the parent or legal guardian of the child who will use the programme.

3.3 We reserve the right to decline an order at our discretion (e.g., safeguarding or capacity limits).


4. Prices, Payments & Billing


4.1 Prices displayed on our website or checkout page are in GBP and inclusive of applicable taxes.

4.2 Payment is taken at the point of purchase. If available, instalment plans must be completed in full.

4.3 Missing or failed payments may result in temporary suspension of access until resolved.

4.4 We may change prices at any time, but changes do not affect an existing purchase already completed.

5. Delivery of Digital Content (Immediate Access)

 

5.1 Digital content is delivered immediately after purchase through the BeBright+Fun platform.

5.2 By accessing any digital content, you acknowledge that the service has begun.

5.3 You must ensure your device meets basic access requirements (internet, browser compatibility, etc.).

5.4 We are not responsible for technical issues arising from your device, settings, or internet connection.

 

6. 14-Day Right to Cancel — Legally Waived (CCR 2013)

 

Under the Consumer Contracts Regulations 2013, consumers normally have a 14-day right to cancel digital content.

However, this right does not apply once you:

  • request immediate access, and

  • acknowledge that doing so waives your cancellation rights.

At checkout, you MUST confirm the following:

“I acknowledge that by completing my purchase I am gaining immediate access to all digital learning materials. I expressly request that these services begin immediately and confirm that I waive my 14-day right to cancel under the Consumer Contracts Regulations 2013. I understand that this programme, including any live lessons included, is strictly non-refundable.”

Once you tick the box and complete purchase:

✔ the 14-day right to cancel is legally waived

✔ the purchase becomes fully non-refundable

This applies to all tiers, including those with live lessons.

 

7. No Refund Policy (All Programmes)

7.1 Because access to digital content is delivered immediately upon purchase, all sales are final.

7.2 This includes programmes that also contain live lessons, Mini Pods or 1:1 mentoring; these are part of the same blended digital service.

7.3 No refunds, partial refunds, or credit transfers are offered for:

  • change of mind

  • non-use or missed sessions

  • scheduling conflicts

  • child disengagement

  • perceived progress

  • personal circumstances

  • technology issues on your side

  • discontinuation of the programme by your choice

7.4 If BeBright+Fun cancels a live session for operational reasons, we will provide a replacement session or equivalent digital support. This is the full extent of our responsibility.

 

8. Live Sessions, Mini Pods & 1:1 Mentoring (if included)

 

8.1 You are responsible for selecting session times that suit your family.

8.2 Spaces are limited and may be allocated on a first-come, first-served basis.

8.3 Children must behave appropriately and follow tutor instructions.

8.4 Cameras are recommended but not mandatory unless otherwise stated.

8.5 We may remove a child from a session if behaviour prevents learning or breaches safeguarding expectations.

8.6 Live lessons cannot be rescheduled if missed. Recordings may or may not be available depending on safeguarding considerations.

 

9. Parent Responsibilities

 

By purchasing, you agree that you will:

  • supervise your child’s use of the platform;

  • ensure the child behaves safely online;

  • support the completion of lessons and worksheets;

  • notify us of any safeguarding concerns immediately;

  • ensure the child does not share login credentials.

 

10. Intellectual Property (IP) Restrictions

 

10.1 All materials remain the exclusive property of BeBright+Fun Ltd.

10.2 You may not copy, share, reproduce, modify, upload, distribute, or use the materials for any commercial or tutoring purpose.

10.3 Accounts found sharing or misusing content may be terminated without refund and subject to legal enforcement.

 

11. Technical Support & Availability

 

11.1 We aim to maintain continuous access but do not guarantee uninterrupted service.

11.2 Planned maintenance or unexpected downtime may occur; no partial refund or extension is owed.

12. Termination of Access

We may terminate access without refund if:

  • you breach these Terms,

  • you misuse materials or share accounts,

  • your behaviour creates safeguarding concerns, or

  • instalment payments fail and remain unresolved.

Upon termination, you must cease use of all materials.

 

13. Limitation of Liability

To the fullest extent permitted by English law:

  • We are not liable for any loss of data, emotional distress, exam results, academic performance, or any indirect or consequential loss.

  • Our total liability is limited to the amount you paid.

  • Nothing excludes liability for death or personal injury caused by negligence.

14. Governing Law & Jurisdiction

 

These Terms are governed by the laws of England & Wales.

Any dispute shall be resolved exclusively in the courts of England & Wales.
